Version v1.0 — 29/07/2026.
Etaligo is published by DATAAPPS & LEARNING, SLU, number L-720967-N, with a share capital of 3,000 euros, trading under the name SOLUCIONS DIGITALS JOA, whose registered office is located at Urb. Can Noguer, Ed. Celistia, Bloc C, 4-2, AD700 Escaldes-Engordany, Principality of Andorra. Full contact details in the legal notice.
Etaligo provides a digital service allowing customers to request access to a seller's catalogue, to send an order to be prepared for a market time slot and to exchange messages about that order.
Etaligo acts as a technical intermediary and as a hosting service provider for the content that sellers publish. Etaligo sells nothing.
The contract for the sale of the products is concluded directly between the seller and the customer. Etaligo is not a party to it. It does not sell, buy, resell, hold or deliver any product; it does not set any price; it does not collect any payment.
In practice, and these are facts, not statements:
The seller remains solely responsible for the products they offer: mandatory information, prices, availability, conformity, food safety, hygiene, labelling, allergens, traceability, preparation, any invoicing and handover to the customer. They are the trader vis-à-vis the customer, and they alone.
Any subscription invoiced to the seller pays for access to the platform. It is not a commission on sales and does not constitute the price of the products sold to the customer.
⚠️ Any move towards integrated payment within the application would change the nature of this role and would require new terms.
The seller subscription is contracted and invoiced outside the application. The mobile application does not allow this subscription to be taken out or paid for. Once the professional contract has been concluded and the account validated by Etaligo, the seller signs in with their existing account to access the features to which they subscribe. The terms as to price, duration, renewal, termination and invoicing are set out in the seller terms and the contract entered into outside the application.
The user provides accurate information, keeps their credentials confidential and reports any unauthorised use. A single account may have both the customer and seller roles.
Use of the service is reserved for adults (18 years of age or over), having capacity to contract. The creation of an account by a minor is not permitted. Nothing, however, prevents an adult account holder from entrusting the collection of an order to a third party of their choice.
Sign-in may be by email/password, Google or Apple. The terms specific to those providers also apply to their service.
The seller warrants in particular:
Etaligo may request supporting documents, refuse or suspend an application and remove any manifestly illegal or dangerous content. Every seller application is reviewed and approved manually by an administrator before the account gains access to the seller functions: nobody grants themselves that role by signing up. Before requesting access to a catalogue, the customer sees the seller's trading name, type of products, description, town and photo.
Before any subscription is invoiced, the seller provides their corporate name, their address, their company identifier and their tax status, as well as their VAT number or their NRT depending on their country of establishment. Etaligo may verify this information and suspend invoicing if it is inconsistent.
As Etaligo is established in Andorra, outside the European Union, the tax treatment of the subscription depends on the seller's country of establishment and on their status as a taxable person:
| Seller established in | Treatment in principle applicable |
|---|---|
| France or Spain, taxable person acting in a professional capacity | Supply located in the customer's country; VAT reverse-charged by the seller. Etaligo invoice issued without Andorran IGI and without the VAT of the customer's country, with the required tax particulars |
| Andorra | Andorran IGI applicable under the conditions of ordinary law |
| European Union, non-taxable person or supporting documents not provided, or to be treated as a final consumer | Etaligo may have to apply the VAT of the country of consumption and use the non-Union OSS scheme |
These rules describe the applicable regime and do not constitute a general exemption. The exact tax particulars, the corresponding reporting obligations and the details of invoicing are set out in the seller contract and on the invoice issued.
The target price for the pilot is 5 euros per month, excluding any taxes that may apply depending on the seller's country of establishment and tax status; the exact amount and its nature appear on the offer and on the invoice. This price is not offered for purchase within the application and may change under the conditions provided for by the seller contract.
Prices are stated in euros and set freely by the seller.
For a product sold by weight, the amount displayed when the order is placed is an estimate based on the quantity requested. Weighing is imprecise by nature: 517 g for 500 g requested is the normal case, and one does not cut a tomato in half. The application therefore allows the seller to prepare up to 10 % more than the quantity requested, or 50 grams more, whichever is the greater. Beyond that, the system refuses the preparation: it is no longer a weighing adjustment, and the seller must discuss it with the customer.
For a product sold by the piece, no overage is possible: counting is not imprecise.
The final amount follows from the weight actually prepared and is communicated to the customer before payment, at collection. The customer never pays an amount they have not seen.
The seller may accept an order in whole or in part, propose a substitution or refuse a free-text request. No substitution is imposed: if it does not suit the customer, they are bound to nothing, since the sale is not yet formed (article 6).
The contract of sale is formed at collection, when the seller hands over the products and the customer pays the price. Everything that precedes it — sending the order, acceptance by the seller, preparation — prepares that sale without concluding it.
This choice follows the reality of the service: no payment takes place before collection, and the final amount of a product sold by weight is not known until the goods have been weighed.
The customer attends during the agreed time slot with their collection code and pays the seller directly, using the means of payment the seller announces. The seller marks the order as handed over after verification.
What follows from this is simple:
The right of withdrawal specific to distance selling has no occasion to be exercised here: the customer commits only at the moment they take the products and pay for them, in the seller's presence. Their position is therefore more favourable than that of a distance purchase, not less.
After collection, conformity, warranty and the handling of complaints are matters for the seller and for the law of the customer's country of residence. The first level of resolution takes place between them, via the order. Etaligo may facilitate the exchanges, without taking the place of the seller's obligations. Users undertake not to publish content that is illegal, misleading, insulting, discriminatory or dangerous, that harms third parties or that contains unnecessary sensitive data. The chat is reserved for the performance of the order.
Links to a website, Instagram or another page are provided under the seller's responsibility. Etaligo does not continuously monitor their content and may remove a link that is dangerous or unrelated to the product.
The user retains their rights in their content and grants Etaligo a non-exclusive licence, limited to the period necessary for the operation and the internal promotion of the listing concerned, to host, adapt to the mobile format and display that content. No external advertising use must be made without a separate agreement.
Etaligo does not generally monitor the content published by sellers and customers, and is under no obligation to do so. It hosts it.
Any person — user or not, private individual or authority — may report content they consider illegal, at the address:
support@climbexdata.com, subject line: REPORT
So that the report can be handled, please state:
What we do next:
The person whose content has been removed is informed of the decision, of its reasons, and may contest it by replying to the same contact. A decision taken in error is reinstated.
💡 Why this section exists. It is this mechanism — and actually applying it — that founds the hosting service provider's liability regime: Etaligo is not liable for illegal content published by a seller for as long as it has no knowledge of it, and provided that it acts promptly once informed. This protection is not obtained through a disclaimer of liability: it is obtained through this conduct.
Abusive use of reporting: manifestly unfounded and repeated reports, like repeated manifestly illegal publications, may lead to the suspension of the account concerned, after a warning.
This section concerns professional sellers only. It does not apply to consumer customers, and does not reduce any right that a consumer enjoys.
The seller indemnifies and holds Etaligo harmless against any sum it may be ordered to pay, or that it may reasonably incur (including defence costs), arising from:
Etaligo informs the seller without delay of any claim likely to give rise to indemnification, and does not settle without their agreement, which may not be withheld without legitimate grounds.
⚠️ This guarantee is a recourse against the seller. It does not shield Etaligo from a consumer or an authority: the mandatory rules on consumer protection and the platform's own obligations apply in any event, independently of this clause.
Push notifications are optional and can be disabled. The essential information remains accessible in the application. Etaligo may be temporarily unavailable due to maintenance, an incident or force majeure and endeavours to restore the service within a reasonable time.
Etaligo may suspend an account or content in the event of a security risk, fraud, serious breach, legal obligation or danger to users, with information and the possibility to object where the situation allows.
The user may request the deletion of their account. Data still necessary for an order, a legal obligation or a dispute may be archived for the justified period in accordance with the privacy policy.
Each party is answerable for its own faults and obligations under the applicable law. No clause limits the mandatory rights of a consumer or the liability that cannot lawfully be excluded. Any caps on liability between Etaligo and a professional seller are a matter for the seller contract entered into outside the application.
Each document carries a version number and a date, at the head of the page. The terms applicable to you are those published on the date of your use. Significant changes are announced before they come into force, and a new acceptance is requested where the nature of the change so requires. We keep the history of the published versions and undertake to record, together with your acceptance, the version accepted.
The relationship between you and the publisher is governed by Andorran law, the place of establishment of DATAAPPS & LEARNING, SLU.
This choice takes no right away from you. If you are a consumer residing in the European Union, you retain the benefit of the mandatory provisions of the law of your country of residence: they apply notwithstanding the choice of Andorran law, and any clause to the contrary would not be enforceable against you.
If you are a consumer, you may bring proceedings before the courts of your country of residence — France, Spain or Andorra. For our part, we undertake not to bring a dispute concerning you before any other court.
If you are a professional seller, disputes relating to your subscription contract fall to the courts of Andorra, unless the seller terms provide otherwise.
For any difficulty, write to support@climbexdata.com. We acknowledge receipt and reply within a reasonable time. For content you consider illegal, use the reporting procedure described in article 7 bis, which provides for a reasoned examination and a right to contest.
Etaligo has not appointed a consumer mediator and is not required to do so. We prefer to write that plainly rather than point you to a mechanism that does not exist. Three reasons, each independent of the others:
For a dispute about your purchase, your counterpart is the seller. A professional seller established in France is subject, for their own sales, to consumer mediation and must give you the contact details of the mediator they fall under. At your request, we forward your complaint to the seller concerned and remind them of that obligation.
You may in addition apply, free of charge, without going through us:
| If you reside in | Service to contact |
|---|---|
| France | The DGCCRF, via SignalConso |
| Spain | The OMIC of your municipality or the consumer body of your autonomous community |
| Andorra | The Servei d'Atenció al Consumidor of the Govern d'Andorra |
These steps are in addition to your right to bring proceedings before the courts; they do not replace it.
💡 This section will be reviewed. Directive (EU) 2025/2647, in force since 19 January 2026, extends out-of-court dispute resolution to traders established outside the Union who direct their activities towards a Member State. Member States must transpose it by 20 March 2028 at the latest. We will review this section at that deadline, and also on the day any payment is asked of the customer, and will appoint a mediator if that becomes necessary.
